Agreement to terms

By installing Pomelo AI Virtual Try-On from the Shopify App Store, or by using the Try-On widget on a merchant's store, you agree to these Terms of Service. If you do not agree, do not use the service.

These terms govern:

• Merchants: your use of the Pomelo AI Virtual Try-On Shopify app
• Shoppers: your use of the Try-On widget on merchant stores

Age requirement

You must be at least 18 years old to install or use Pomelo AI Virtual Try-On as a merchant. By installing the app, you confirm you meet this requirement.

For shoppers using the Try-On widget, the minimum age is determined by the merchant's store terms and applicable law in your jurisdiction. If you are under 18, you should have parental consent before uploading photos.

What Pomelo AI Virtual Try-On does

Pomelo AI Virtual Try-On provides:

• An AI-powered virtual try-on widget for Shopify product pages.
• A merchant admin dashboard for configuration and analytics.
• A Preview Studio for merchants to test results before going live.

The service uses AI-powered technology to generate images of shoppers wearing merchant products. Results are generated automatically by our AI processing partner and are not manually reviewed.

AI-generated content

By using the Try-On feature, you acknowledge:

• Results are generated by AI and may be imprecise.
• The image does not constitute a guarantee of product fit, colour accuracy or appearance.
• Purchase decisions should be based on the product's official images and size guides, not on Try-On results.

Merchants must not use AI-generated try-on images as primary product images, in advertising, or in any context that could be interpreted as a factual representation of the product.

Ownership of generated images

AI-generated try-on images are derivative works produced by AI models. No party — including the shopper, the merchant, or Pomelo AI Virtual Try-On — holds exclusive copyright over the generated output.

Generated images:

• Are deleted from our servers within 1 hour of generation.
• May not be downloaded and used as product photography.
• May not be used in advertising or marketing materials.
• May not be represented as accurate depictions of the product.

Pomelo AI Virtual Try-On retains no ongoing rights to generated images after deletion. Shopper-uploaded photos remain the shopper's property at all times.

Merchant responsibilities

As a merchant using Pomelo AI Virtual Try-On, you are responsible for:

• Ensuring your store's privacy policy discloses the use of AI try-on technology and photo processing.
• Informing shoppers that photos are temporarily processed by our service's AI technology.
• Not enabling the Try-On feature for product categories where AI results would be misleading or inappropriate.
• Complying with all applicable laws in your jurisdiction.

Billing, plans and overages

Billing is processed exclusively through Shopify's billing system, using Shopify's Recurring Application Charge API. All payments are subject to Shopify's Terms of Service.

Overage charges: if your store exceeds your plan's monthly try-on limit, additional try-ons are charged at a flat rate per try-on. The overage rate for your plan is shown in the Billing section of your Pomelo AI Virtual Try-On dashboard. Try-ons continue uninterrupted — your shoppers are never shown an error due to plan limits.

Plan changes take effect at the start of your next billing cycle. The Free plan is a one-time allowance of 10 try-ons that does not expire and does not renew; paid plans renew every 30 days.

Refunds: subscription fees are non-refundable except where required by applicable law. If you believe a charge is incorrect, contact support@pomelolabs.online within 30 days.

Acceptable use

You may not use Pomelo AI Virtual Try-On to:

• Process images of individuals without their consent.
• Generate deceptive or misleading product representations.
• Circumvent Shopify's Terms of Service.
• Attempt to extract, reverse-engineer or abuse the AI integration.
• Use the service for products that are illegal in your jurisdiction.

Service availability

We aim for high availability but do not guarantee uninterrupted service. Pomelo AI Virtual Try-On depends on our AI processing partner's availability for image generation. During AI processing outages, try-on requests fail gracefully — shoppers see an error message, and no charges apply for failed generations.

Limitation of liability

To the maximum extent permitted by applicable law:

• Pomelo AI Virtual Try-On is provided "as is" without warranties of any kind.
• We do not warrant that AI results will be accurate, realistic, or meet any particular standard.
• We are not liable for any purchase decisions made based on AI-generated try-on results.
• Our total liability to any merchant shall not exceed the fees paid to us in the three months preceding the claim.
• We are not liable for indirect, incidental or consequential damages of any kind.

Termination

Merchants: you may terminate by uninstalling the app from your Shopify admin at any time. Upon uninstallation, your data is deleted within 30 days, per our privacy policy. Billing stops at the end of your current billing cycle.

We may terminate or suspend access for violation of these terms, abuse of the service, or non-payment, with or without notice depending on severity.

Governing law

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of India.

Nothing in this section limits any mandatory consumer protection rights you may have under the laws of your country of residence.

Changes

We may update these Terms from time to time, for example to reflect changes to our practices or for operational, legal or regulatory reasons. We will notify merchants of material changes via the Shopify admin at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
